The pandemic has also shaken the statistics. It is therefore difficult to find the pulse of the figures and for them to indicate a precise trend. In this sense, everything indicates that criminal activity has returned with more intensity after the covid and the police and judicial indicators bear witness to this. However, this statistical trigger should not result in an increase in, for example, the prison population as a mirror of the above. To insert, educate, raise awareness, train and correct criminals in their own mistakes, this time translated into criminal offences, there is also the service for the management of sentences and alternative measures, which last year reached 2,655 sentences. A third of them, up to 863, are due to gender-based violence, 632 are protagonists convicted of road safety offenses and 1,160 are convicted of other offenses. 91% of the total beneficiaries of these alternative measures are men, while 9% are women. It is a service dependent on the penitentiary center, made up of a multidisciplinary team of educators and specialists in psychology and social work. which coordinates anyone who is sentenced to follow a specific training program or workshop (on gender violence, sexual violence, road safety…) or to work for the benefit of the community, the well known as labor community, which is carried out in certain departments of municipalities or other types of entities. If the growth of the said sentences and alternative measures (as mentioned at the bottom of the article) has grown exponentially, the suspended sentences have not done less. In total, in 2021, up to 790 people have avoided prison in exchange for carrying out this type of work for the benefit of the community. But it is that during the current year 2022, the convicts who have had their prison sentence suspended for an alternative measure have already exceeded 700. The reference convicts for whom this measure seems suitable are those who are sentenced to less than two years in prison and they are first offenders, that is to say they have committed their first crime.

types of crime

Most of them are sentenced to work for committing gender-based violence crimes (up to 342 convicts have been forced into treatment programs for gender-based violence perpetrators) or many of them receive sentences for trafficking drugs and are diagnosed as suffering from a serious addiction. . For the first, those sentenced for ill-treatment, it must be taken into account that they must also respect the accessory penalties such as the prohibition to approach and contact the victim if a protection order is decreed in his sentence and also they will have to participate in therapeutic programs specific to the crime they have committed and therefore be trained in equality courses. For those who suffer from some type of addiction, whether they are drug addicts or alcoholics, the substance detox program is also activated so that they can deal with the problem.

In the event of non-compliance with these measures and a negative report of the service to the court, the latter may revoke the alternative sentence and the prisoner must then serve the prison sentence which had been suspended in exchange for the execution of the work.
